During the pendency of the petition, the Sandiganbayan found no probable cause to proceed with the trial in, and thus dismissed Criminal Case No. 28093 by Resolution of September 7, 2006, and denied the prosecution's motion for reconsideration by Resolution of February 28, 2007.[7] The petition insofar as it concerns Criminal Case No. 28093 is thus effectively mooted, the issues raised therein having ceased to present a justiciable controversy such that a determination thereof would be of no practical use and value.
