A subject matter is the item with respect to which the controversy has arisen, or concerning which the wrong has been done, and it is ordinarily the right, the thing, or the contract under dispute.[29] On the other hand, a cause of action is an act or omission of one party in violation of the legal right of the other.[30] The sole and common objective of petitioners and respondents in filing their respective original actions for certiorari and in impleading therein the NLRC as public respondent was to secure the reversal of the NLRC's Decision. By definition, therefore, the subject matter and the cause of action of the two original actions is the assailed Decision promulgated by the NLRC.
