On the other hand, the right to speedy trial, as an adjunct to the right of all persons to a speedy disposition of their cases before judicial, quasi-judicial, or administrative bodies, requires that court proceedings should be conducted according to fixed rules and must be free from vexatious, capricious and oppressive delays. [60] In the determination of whether or not the right to speedy trial has been violated, the factors that may be considered and balanced are length of delay, reason for the delay, assertion of the right or failure to assert it, and prejudice to counsel by the delay. [61]
