On August 28,1997, the CA[4] ruled that among the Plaza siblings, namely: Aureliano, Emiliana, Vidal, Marciano, and Barbara, Barbara was the owner of the subject agricultural land. The decision became final and executory and Barbara's successors, respondents Guillermo Lustiva, Eleodora Vda. de Martinez and Vicky Sayson Goloseno, have continued occupying the property.
